These Terms govern the Emlivo website, mobile application, digital service and distance sales of Emlivo products. Contracts may be concluded in Hungarian or English. Mandatory consumer protection in the consumer's country remains unaffected.

This document becomes publishable only after all mandatory merchant details, effective date and legal approval are complete.

A Memory is one photograph, one video and related metadata; it is a source, not a product. Digital Emlivo is the personalized print-ready file and its contracted AR/video access. The printed mark identifies a request but does not permanently authorize playback.

Viewing requires no account. Creating, managing and ordering require an account. A paid contract may be made only by a person with legal capacity or a proper representative. Keep credentials confidential and report unauthorized access.

The creator uploads media, prepares the product and receives a protected, watermarked review. An order freezes the selected product, price, tax, retention and rights. Entitlement then authorizes production and a short-lived protected download. Viewing requires a supported device, the app, internet and usable print/camera conditions.

Digital Emlivo is available where an active store offer is shown. Printed and Framed Emlivo are personalized physical products available only to Hungarian delivery addresses and only when the checkout shows an active offer. A non-orderable product description is not an offer.

Product pages invite an offer. The customer submits it after reviewing the summary and pressing a button that clearly communicates payment. A technical receipt confirms arrival; the contract is formed when payment is authenticated and acceptance is confirmed on a durable medium.

The final pre-payment total states VAT and every additional charge. For new Hungarian physical orders, delivery costs HUF 990 for Printed Emlivo and HUF 1,490 for Framed Emlivo, including applicable tax. The exact product-specific delivery fee and total are shown in the order summary before payment and frozen with the order. These new terms do not change the recorded delivery fee of an earlier order. Web orders use the activated Stripe Checkout methods; iOS/Android digital goods use the applicable StoreKit or Google Play Billing offer. Hungarian physical goods may be paid by card or a supported wallet. Cash on delivery is not offered. A failed or pending payment grants no download or fulfilment entitlement.

We make the approved photograph in the ordered size and finish, check it and pack it. Order details show preparation, production, printing, packing and dispatch. The applicable promised or estimated fulfilment time is disclosed before payment; an estimate does not remove mandatory rights for delay.

Delivery within Hungary may be to the home address or a parcel locker. Emlivo may propose a delivery mode based on parcel size, availability and fulfilment cost. For a parcel locker, the specific pickup point and collection conditions must be agreed with the customer before dispatch and their express approval recorded. We do not unilaterally replace the supplied address with an arbitrary locker or treat silence as approval. If locker collection is unsuitable or unavailable, we agree home delivery or another mutually accepted solution.

The delivery fee disclosed before payment does not increase because home delivery or an agreed locker is used. Provide a correct, reachable recipient name, address and phone number and contact support promptly for corrections; this does not remove Emlivo's responsibility for defective or late fulfilment.

When actual dispatch is recorded, we send a service email containing the tracking code and order link; a push notification is also sent when enabled and available. The tracking code remains available in order details. Push delivery depends on device and system settings; these are not marketing messages. Dispatch does not mean delivery. Mandatory claims for damage, loss or non-conformity may be pursued against Emlivo's service provider, not only the delivery provider.

Upload and processing time depends on size, connection and provider load. The system reports status and supports resumable large uploads. If Emlivo cannot bring digital performance into conformity within a reasonable time, mandatory remedies including repair, price reduction or termination remain available.

Consumers normally have 14 days to withdraw from a distance contract. For non-tangible digital content, that right is lost after performance starts only with express prior consent, acknowledgement of the loss and durable confirmation. Personalized physical goods may fall under a statutory exception, without removing conformity or warranty rights.

Digital content and services must provide the promised functionality, compatibility, quality, access and term. Hungarian Civil Code and Government Decree 373/2021 apply where mandatory. The applicable physical-goods conformity and warranty information is shown before an eligible physical order is placed.

The user keeps their rights and grants Emlivo a non-exclusive licence limited to the purpose, territory and retention period necessary to store, encode, resize, produce and provide the requested service to authorized viewers. For a physical order, this includes an authorized staff member downloading the print-ready photograph approved for that specific order, printing, framing, checking, packing and delivering the ordered copies, only as necessary for fulfilment or justified correction. An authorized print or logistics provider may receive only the file or data necessary for its own task, subject to appropriate confidentiality and privacy duties, and acquires no independent reuse rights. Physical fulfilment does not require general access to the user's other photographs or videos. The licence does not permit advertising, public disclosure, independent sale of the content or AI training. The user warrants the required copyright, likeness, voice and privacy permissions. This licence does not waive mandatory withdrawal, refund or conformity rights.

Unlisted is not searchable, not secret: a person who sees the print may request access. Owners may change access or disable viewing. Short-lived grants make revocation effective, subject to the disclosed bounded offline window.

Illegal, infringing, non-consensual intimate, exploitative or hateful content; malware; enumeration; security bypass; misuse of another account/payment/media; and deceptive use of the Emlivo mark are prohibited. Proportionate restriction and evidence preservation may follow a credible report or direct risk.

Internet, stores, hosting, video processing, maintenance and devices can cause temporary interruption. Purchased rights are frozen at order and cannot be shortened by later catalogue changes. Material digital-service changes follow mandatory notice and termination rules.

An owner may request closure. Active orders, disputes and legal holds can pause execution. Drafts and media unnecessary to an issued product are deleted; a purchased and issued Emlivo remains anonymously scannable and playable under its existing access mode after detachment from the account, but can no longer be managed by that deleted account. Refund, legal, safety and separately requested publication-withdrawal controls remain distinct.

Emlivo remains liable under mandatory law. Nothing excludes intentional harm, injury, product liability or any non-excludable consumer right. The user is responsible for lawful content, source-file backup and correct printing; this does not excuse a defective Emlivo output.

Written complaints may be sent to panasz@emlivo.hu and are normally answered with reasons within 30 days. Consumers may use the competent Hungarian conciliation body after attempting direct resolution. The former EU ODR platform closed on 20 July 2025, so no obsolete ODR link is provided.

Hungarian law applies without removing mandatory protection in an EEA consumer's home country. The accepted version is frozen with the order. Amendments govern future contracts unless a lawful, notified change to an ongoing digital service applies.
